Preamble
The present conditions are concluded on the one hand between, the company SCEA BE GOUP Domaine de Bonaguil, registered in the Register of Commerce and of the companies of Cahors under the N°831 295 084 located in Aux Ardailloux 46700 SOTURAC, hereinafter referred to as “the user” the parties agree that their relations are governed exclusively by this agreement, excluding any conditions previously available on the site. If a condition were to fail, it would be considered to be governed by the uses in force in the distance selling sector whose companies have their headquarters in France.
The site www.domainedebonaguil.com is hosted by the company OFFENSIVE.
Acceptance
The sole fact of placing an order of goods on the site www.domainedebonaguil.com leads to the full and unreserved acceptance of our General Terms and Conditions of Sale.
“The user” acknowledges having read and approved each of the clauses constituting these General Terms and Conditions of Sale.
The acceptance of “the user” is materialized by the electronic signature made by “click of validation and payment” and the communication of its bank details to our partner Paypal for the electronic payment of the amount of the order. “The user” further declares, have the ability to enter into this contract.
Purpose
The present conditions aim to define the terms of sale between Domaine de Bonaguil and the user: from order to services, through payment and delivery. They shall regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.
1) Purchase Order
The user places his order online from the site references. The order can only be registered on the site if the user has clearly identified himself by his email address as well as his password after creating his customer account.
The acceptance of the order is materialized by an order number communicated with the details by email to the customer.
Any order is deemed to be acceptance of prices and descriptions of the products available for sale.
The company SCEA BE Group Domaine de Bonaguil undertakes to honor orders received on the website only within the limits of the available stocks of the products. In the absence of availability of the product, Domaine de Bonaguil undertakes to inform the user as soon as possible and to refund by check the missing reference within thirty days.
SCEA BE Group Domaine de Bonaguil reserves the right to cancel the order of the user with whom there is a dispute relating to the payment of a previous purchase order.
2) Delivery of Goods
The user has the option of being delivered to another address different from that of his purchase order.
Delivery to home or a different address all our deliveries will be made by mail or private carrier. The delivery package is included in the order confirmation at the time of payment. This delivery package only includes deliveries in metropolitan France (excluding overseas territories and Corsica).
The user receives an order confirmation email after validation of his basket.
SCEA BE Group Domaine de Bonaguil undertakes to deliver the ordered items as soon as possible (maximum of 15 working days). The time limit cannot result in cancellation of the order or compensation to the customer.
SCEA BE Group Domaine de Bonaguil cannot be held responsible for the consequences of a delay in delivery of its carrier.
In case of delivery to a country other than metropolitan France, the user is importer of the products ordered. Customs duties and formalities shall be borne exclusively by the user. The user is solely responsible for verifying the possibilities of importation of the products ordered under the law of the territory of the country of delivery.
For deliveries outside the EEC and overseas territories additional taxes are payable in respect of customs and other import duties. These sums will be fully borne by the user and the responsibility both in terms of declarations and payments to local authorities.

3) Returns of Goods
SCEA BE Group Domaine de Bonaguil undertakes to refund or exchange defective or non-conforming products.
For this the user has a time limit of 48 hrs, upon receipt of the parcel, to send us an email indicating the problem in very detail.
At the time of receipt of the product, if the user continues that the packaging is damaged, we invite him to check the product immediately. The user shall notify the damage in writing on the delivery note before receipt.
The user may return the goods only after our written agreement. The return fee will be refunded to the user up to the shipping fee charged. This return must take place within 7 days of delivery of the order.
The refund will be made by bank check sent to the name of the user who placed the order and to the billing address.
4) Right of Withdrawal
The user has seven (7) clear days to return, at his own expense, products not suitable for him/her. This period runs from the day of receipt of the parcel.
The user will be reimbursed for the sums paid, within thirty days upon receipt by SCEA BE Group Domaine de Bonaguil, and under conditions that the product is in its condition and unopened original packaging.
5) Terms of Payment
The user has the choice of paying his purchases online secured by credit card (Visa, Mastercard, Maestro, CB) or to use his Paypal account.
The user guarantees to the company SCEA BE Group Domaine de Bonaguil that he has the necessary authorizations to use the method of payment by credit card, when validating the purchase order.
Credit card data are not held or retained by SCEA BE Group Domaine de Bonaguil at the time of payment and after payment.
The validation of the order by means of the credit card number and the expiry date is a mandate to pay the price shown on the invoice (including taxes and participation in the charges of ports) that the payment server transmits to the credit institution of the customer.
SCEA BE Group Domaine de Bonaguil makes every effort to ensure the confidentiality and security of data transmitted on the web.
As such, as part of online payment, we have chosen the secure module of Paypal.
Prices are quoted in Euros including all taxes (including VAT). They shall consider the VAT applicable on the day of the order.
All orders are payable in Euros.
Any applicable rate changes may be reflected in product prices. After that date, they are subject to change at any time.
6) Default of Payment
In the event of a total non-payment of the invoice, SCEA BE Group Domaine de Bonaguil reserves the right to bring the user before the judge or court.
All costs of such a procedure shall be borne by the user. SCEA BE Group Domaine de Bonaguil reserves the right to claim any material in the event of default.
The user undertakes to return any product not paid in full to SCEA BE Group Domaine de Bonaguil, all costs at his expense within 30 days, upon first request from SCEA BE Group Domaine de Bonaguil.
7) Signature Guarantees
The online supply of the credit card number and the final validation of the order shall prove the entire order in accordance with the provisions of the law of March 13, 2000 and shall be vowed by the sums incurred by the seizure of the items appearing on the purchase order.
This validation shall constitute an express signature and acceptance of all the operations carried out on the site.
Responsibilities
The products on sale on the website of the Domaine de Bonaguil are to be kept out of children’s reach.
The company SCEA BE Group Domaine de Bonaguil has, for all stages of access to the site, the ordering process, delivery or subsequent services, only an obligation of means. The liability of SCEA BE Group Domaine de Bonaguil cannot be incurred for all the disadvantages or damages inherent in the use of the Internet network, including a breakdown of service, external intrusion or the presence of computer viruses, or otherwise qualified as force majeure, in accordance with the case-law.

Intellectual Property

Duration
These conditions apply throughout the period of online delivery of the services offered by the company SCEA BE Group Domaine de Bonaguil.
Litigation
In the event of a dispute, in the absence of an amicable agreement, only the Cahors Trade Court will be competent.
